根据《劳动合同法》和国家有关规定,甲乙双方经平等协商一致,自愿签订本合同,共同遵

守本合同条款:According to the “labor contract law” and the relevant provisions of the state,
through equal consultation between both parties’ agreement, sign this contract voluntarily,
abide by the terms of this contract

一、劳动合同期限 Term of the Labor Contract
本合同期限类型为______期限合同 The type of the contract is ___________ contract(填
“有固定或无固定”其中一项)( Fulfill terminable or dateless )。
本合同期限为___年 The term of the contract is _____ years,自___年___月___日起至___
年___月___日止。from ____________ to ____________. 双方约定的试用期至___年____月____
日 止 , 期 限 为 3 个 月 。 The two sides agreed probation period ends on ____________, 3
months’ duration. 表现优异者,甲方可缩短试用期,但不能少于 1 个月。For the outstanding
laborer, the probation period can be shortened by Party A, but no less than 1 month.

以完成一定工作为期限:Based on a fixed working term: 从___年___月___日起,到任务
完成时止。starting from _____________ until the task is finished.
二、工作内容和义务 Job Content and Responsibility
1、乙方同意根据甲方工作需要 , According to Party A’s demand, 在部门,从事 ______
(管理、销售、技术、生产、后勤等)工作,并遵守岗位工作制度与合理的工作安排(包括但
不 限 于 工 作 内 容 、 工 作 地 点 )。 Party B agrees to engage in __________

(management/sales/technology/manufacture/logistics etc.) work in the department and

abide by the work system and reasonable work arrangement. (Included but unlimited to

job content & working place.)

2、乙方应当按照甲方岗位职责要求,保质保量完成工作任务; According to Party A’s
post responsibility requirement, Party B should finish working task with quality and

quantity guaranteed.

3、甲方本着“一专多能、一职多岗”的用人原则,可以根据经营需要及乙方的工作能力调整
乙方的工作职务和岗位,乙方应服从安排。Based on the principle of “one skill with multiple
ability, one post with multiple work”, and according to the business demand and Party

B’s competence, Party A may adjust Party B’s duty and post, while Party B should obey

the adjustment.

三、劳动保护和劳动条件 Labor Protection & Labor Condition
1、甲方根据国家有关安全生产、劳动保护、职业卫生的规定,为乙方提供必要的工作条件
和劳动保护设施,保障乙方的安全与健康; According to the related stipulation of safety
manufacture/labor protection/occupational health from the state, Party A provides

necessary working condition and labor protection facilities, insuring Party B’s safety and

health.

2、甲方根据国家有关规定制定工时制度,乙方确因生产经营需要延时的,甲方应当依法安
排乙方补休或支付相应的加班费;若乙方实行的是级别工资,则在当月的绩效考核中体现;
According to the relevant regulations of working hour system, if Party B needs to extend

the working hours due to the need of production and operation, party A shall arrange

party B compensatory time off or pay overtime salary in accordance with the law; If party

B is implemented wage levels, the compensation should be reflected in the performance

appraisal for the month.

3、甲方根据国家有关规定为孕期、产期、哺乳期的女职工提供劳动保护;Party A should
provide protection for women workers in pregnancy, childbirth, breastfeeding, in

accordance with the relevant provisions of the State.

4、甲方负责对乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的
告知、教育和培训。Party A is responsible to provide political ideology, professional ethics,
business technology, labor safety and hygiene, and related rules, education and training

for Party B.

四、劳动报酬 Labor remuneration
根据“按劳分配”原则,实行同工同酬,乙方的报酬不得低于当地最低工资标准。具体薪酬标
准、支付方式以及支付时间按公司制定的《薪酬管理制度》执行。According to the principle
of distribution, and equal pay for equal work, remuneration of Party B shall not be lower

than the local minimum wage standard. Specific compensation standards, payment, and

time is set by the “the system of compensation management” by the company

五、社会保险 Social Insurance
甲方应按照国家有关社会保险的法律、法规和政策为乙方缴纳基本养老、基本医疗、失业、
工伤、生育保险费用;社会保险费个人缴纳部分,甲方从乙方工资中代扣代缴。In accordance
with national laws, regulations and policies relating to social insurance, Party A shall pay

the basic pension, basic medical, unemployment, work injury and maternity insurance

costs, for the Party B; social insurance premiums paid by individuals part is withhold

wages from Party B.

六、劳动纪律和规章制度 Labor discipline and regulations
1、 甲 方 依 法 制 定 的 劳 动 纪 律 和 规 章 制 度 , 乙 方 有 义 务 遵 守 ; Labor discipline and
regulations legally stipulated by party A, party B shall have the duty to abide by it.

2、签订本合同前,甲方已对乙方进行了劳动纪律、操作规程、管理制度等相应的培训;
Before signing this contract, Party A has to provide party B the labor discipline, operating

procedures, management system and the corresponding training

3、 乙 方 应 当 遵 守 甲 方 的 工 作 操 作 规 程 , 服 从 工 作 安 排 ; Party B shall abide by the
working procedures, obey the work arrangement of party A.

4、乙方违反劳动纪律或规章制度,甲方有权按本单位的规章制度,给予纪律处分,直至解
除本合同。If Party B violates labor discipline or regulations, Party A is entitled by the rules

of the unit to give Party A disciplinary action, up to terminate this contract.

七、劳动合同的变更 The change of labor contract
订立本合同所依据的客观情况发生重大变化,致使本合同无法继续履行的,经双方协商同
意,予以变更劳动合同相关内容。If the objective situation this contract based on, changes
significantly, to result the contract unable to perform, by mutual consent, related content

in labor contracts shall be changed.

八、劳动合同的解除 The remove of labor contract
( 一 ) 双 方 协 商 一 致 , 劳 动 合 同 可 以 解 除 。 The two party may terminate the labor
contract with mutual agreement.

(二)乙方有下列情形之一的,甲方可以即行解除劳动合同: Of any of the following
circumstances, party A may immediately terminate the labor contract.

1、在试用期内被证明不符合录用条件的; Been proven not to meet the conditions of
employment during the trial period.

2、采取欺诈手段订立本合同的;Adopted fraudulent means to enter into this contract.
3、 严 重 违 反 劳 动 纪 律 或 规 章 制 度 给 甲 方 造 成 重 大 损 害 的 ; Seriously violated labor
discipline or regulations to cause significant harm to the Party A.

4、严重失职、营私舞弊,或泄露甲方商业秘密,给甲方利益造成重大损失的; Gross
negligence, malpractice, or disclosure of trade secrets Party A, to cause heavy losses

to the interests of the Party A.

5、乙方同时与其他用人单位建立劳动关系,对完成本单位的工作任务造成严重影响,或者
经用人单位提出,拒不改正的;Party A built labor relationships with other unit, to cause a
serious impact on the completion of the tasks of the unit, or refused to correct the rules

made by the employer

6、被依法追究刑事责任的。Be investigated for criminal responsibility according to law
(三)有下列情形之一的,甲方可以提前 30 日以书面形式通知乙方解除劳动合同:Of the
following circumstances, Party A can give notice to inform Party B to terminate the labor

contract ahead of 30 days.

1、 乙 方 不 能 胜 任 工 作 , 经 培 训 或 调 整 工 作 岗 位 仍 不 能 胜 任 工 作 的 ; Party B is not
competent for work, after training or adjustment of jobs.

2、乙方患病或者非因工负伤,医疗期满后,不能从事原工作,也不能从事甲方另行安排工
作 的 ; Party B was ill or injured due to non-work relation, after completion of medical,

Part A is not competent for his original work, or alternative arranged jobs.

3、劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,双方协商不
能就变更劳动合同达成协议的。 If the objective situation this contract based on, changes
significantly, to result the contract unable to perform, mutual consent can not be

reached, in change of this labor contracts.

(四)有下列情形之一的,甲方可以提前 30 日通知工会,经工会同意后,与乙方解除劳动
合 同 : Of the following circumstances, Party A can give notice ahead of 30 days, to

inform the Labor Union, after agreement, Party A may terminate the labor contract.

1、 甲 方 依 照 企 业 破 产 法 规 定 进 行 重 整 的 ; Party A restructured pursuant to the
Enterprise Bankruptcy Law

2、甲方生产经营发生严重困难的;Production and business operation of Party A met
serious difficulties.

3、甲方转产、重大技术革新或者经营方式调整,经变更劳动合同后,仍需裁减人员的;

production, technological innovation or business method of Party A adjusted, after the

change of labor contracts, still needed to reduce staff.

4、其他因劳动合同订立时依据的客观经济情况发生重大变化,致使劳动合同无法履行的。
If other objective situation this contract based on, changes significantly, to result the

contract unable to perform.

( 五 ) 乙 方 有 下 列 情 形 之 一 的 , 甲 方 不 得 解 除 劳 动 合 同 : Of any of the following
circumstances, party A can not terminate the labor contract.

1、在本单位患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的;Injured due to
occupational disease or work-related reasons, and was confirmed as having lost or

partially lost the ability to work.

2、患病或者非因工负伤,在规定的医疗期内的;Illness or non-work related injury within
the prescribed period of medical treatment.

3、 女 职 工 在 孕 期 、 产 期 、 哺 乳 期 的 ; women workers in pregnancy, childbirth,
breastfeeding.

4、在本单位连续工作满十五年,且距法定退休年龄不足五年的;Worked continuously for
15 years and less than five years away from his legal retirement age In this unit.

5、 法 律 、 行 政 法 规 规 定 的 其 他 情 形 。 Other circumstances stipulated by laws and
administrative regulations.

(六)乙方解除劳动合同,应当提前三十日(试用期内提前三日)以书面形式通知甲方,甲
方 在 乙 方 完 成 业 务 以 及 清 理 完 债 权 债 务 的 情 况 下 , 可 以 解 除 劳 动 合 同 。 Of the following
circumstances, Party B shall give notice to inform Party A to terminate the labor contract

ahead of 30 days after cleaning up the credits and debts.

( 七 ) 有 下 列 情 形 之 一 的 , 乙 方 可 以 通 知 甲 方 解 除 劳 动 合 同 : Of the following
circumstances, Party B may give notice to inform Party A to terminate the labor contract.

1、在试用期内的;During the trial period.
2、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;Party A forced Party A
to labor by violence, threat or illegal restriction of personal freedom.

3、甲方未按劳动合同约定提供劳动保护和劳动条件的; Party A failed to provide the
labor protection and labor conditions.

4、 甲 方 未 按 照 劳 动 合 同 的 约 定 支 付 工 资 报 酬 的 ; Party A failed to pay wages in
accordance with the labor contract.

5、 法 律 、 行 政 法 规 规 定 劳 动 者 可 以 解 除 劳 动 合 同 的 其 他 情 形 。 Other circumstances
stipulated by laws, administrative regulations by which employee may terminate the labor

contract.

九、劳动合同的终止 Termination of labor contracts
(一)有下列情形之一的,劳动合同即行终止:Of any of the following circumstances,
the labor contract may be immediately terminate

1、劳动合同期满的;The labor contract expired.
2、 劳 动 者 开 始 依 法 享 受 养 老 保 险 待 遇 的 ; Workers began to enjoy endowment
